• Allowing visitors to contribute memories and condolences
• Managing memorial privacy and settings

3. Account Registration

To create memorials, you must register for an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account. By registering, you represent that you meet this requirement.

4. User Content

Your Responsibilities

You are solely responsible for content you upload, including:

• Ensuring you have the right to share all content

• Not uploading illegal, harmful, or offensive content

Content License

By uploading content, you grant Stonely.ai a non-exclusive, worldwide license to host, display, and distribute your content solely for the purpose of providing the Services. You retain all ownership rights to your content.

Prohibited Content

You may not upload content that:

• Infringes on intellectual property rights
• Contains malware or harmful code
• Is defamatory, obscene, or offensive

• Misrepresents the identity of the deceased

5. Memorial Management

As a memorial creator, you have control over:

• Memorial content and appearance
• Privacy settings (public, private, password-protected)
• Approval of visitor contributions
• Deletion of the memorial

We reserve the right to remove memorials that violate these Terms or are reported for inappropriate content.

6. Subscriptions and Payments

Subscription Plans

We offer free and paid subscription plans. Paid subscriptions provide additional features such as unlimited media storage, custom themes, and QR code generation.

Billing

• Payments are processed securely through Stripe
• Subscriptions automatically renew unless canceled
• You may cancel at any time; access continues until the end of the billing period
• Refunds are provided in accordance with our refund policy

Price Changes

We may modify subscription prices with 30 days notice. Existing subscribers will be notified before any price changes take effect.

7. QR Codes

QR codes generated through our Services:

• Are provided for personal memorial use only
• Remain functional as long as your subscription is active
• May not be resold or used for commercial purposes
• Link directly to your memorial page on Stonely.ai

8. Intellectual Property

The Stonely.ai platform, including its design, features, and technology, is protected by intellectual property laws. You may not:

• Copy, modify, or distribute our platform code
• Use our trademarks without permission
• Reverse engineer or attempt to extract source code
• Create derivative works based on our Services

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Termination

We may suspend or terminate your account if you:

• The Services will be uninterrupted or error-free
• Content will be preserved indefinitely
• QR codes will function permanently
• The Services will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STONELY.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

13. Indemnification

You agree to indemnify and hold harmless Stonely.ai and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.
